PL1. Amendment to Article 13 of the Constitution (3/4 vote of Floresters and 2/3 of Council of State required for adoption).

TEXT:

Article 13 of the Constitution is hereby amended to add the following paragraph:

"Fourth Paragraph - If the Council of State fails to act upon a bill submitted by the Council of Floresters within 14 (fourteen) days following its approval by the Floresters, the bill will become law upon promulgation by the Speaker of the Council of Floresters, even though no action was taken by the Council of State. This paragraph does not apply to amendments to the Constitution."

TEXT:

Article 1. Be it enacted by the Council of Florestiers that the following dates be set aside as national (and where indicated, provincial) holidays in the Principality of Orange:

March 22 - Lafayette Independence Day (in Lafayette, commemorating Lafayette's independence from the United States in 1960)

May 1 - Labor Day

July 24 - Founders' Day (in Utrecht, created by the first draft Constitution of this date)

August 27 - Constitution Day

October 28 - Princess Anne's Birthday.

November 11 - Exodus Day

November 16 - Independence Day

December 1 - Magna Carta Day (in Pirraines)

Article 2. The provisions of this Act shall not be construed to prohibit the Provincial Governments from declaring additional holidays within their territories, nor to infringe on the right of Laranjian citizens to observe religious holidays appropriate to their faith.

PL6 - Judiciary Act (Oliveira)

TEXT:

CHAPTER I GENERAL DISPOSALS

Art. 1° - The Judiciary Branch of the Principality of Orange will be organized according to this law, pursuant to the Constitution.

Art. 2°. Oranger Justice emanates of the people and if it manages in its name for judges, integrant of the judiciary branch, independent, responsible and submitted to the rule of Law. The special courts are forbidden.

Art 3º - Access to the Judiciary is a right of all Orange citizens. Justice cannot cause injury or threaten the right of citizens of the Principality.

CHAPTER II COMPOSITION OF THE JUDICIARY BRANCH

Art. 4° - the Judiciary Branch of Orange is formed by the Upper Court of Justice and its judges.

Only paragraph - the headquarters of the Judiciary Branch are the city of Oiapockdam.

CHAPTER III THE JUDGES OF THE PRINCIPALITY

Art. 5°. The Judges of the Principality are indicated by the Secretary General, between the citizens with law knowledge and well-known wisdom and will be in minimum number of 01 (one) and maximum of 05 (five).

First paragraph - Appointment of Judges will have to be approved by the Council of the Forest. In case of parliamentary veto, the Council of State will decide.

Second Paragraph - When there is only one Judge, the Council of State will judge appeals.

Third Paragraph - No Judge can hold any another public office, nor to be managing, majority partner or proprietor of a corporation.

Art 6° - the definition of the number of judges will follow the formula below:

Less than 60 citizens - 01 judge; More than 60 - will add two judges to each 60 citizens.

Art 7º - a Judge could be dismissed of his position, for the practical of any harmful act to Justice, by means of process lead for the Council of State.

Chapter IV The Upper Court of Justice

Art. 8°. The Upper Court of Justice is the maximum agency of the Judiciary Branch and will be composed for the Judges of the Principality, acting collegially.

Art. 9°. In the case of the country has 03 (three) or more judges, all the appeals will be directed to be processed and judged for the UCJ.

Only paragraph - In the hypothesis of this article, the decisions of the UCJ are inappellable.

Art 10. The UCJ will have original jurisdiction for process and judge the cases where the members of the Council of Floresters, the Council of State or the Secretary General are plaintiff or defendant, in virtue of act practised in the exercise of his functions.

Only paragraph - In the event the UCJ is not functioning, the Council of State will have ability to judge the cases of this article, directed by a Judge of the Principality. In case that the defendant is a member of the Council of State, the Speaker of the Council of Floresters will supply the vacant position.

Chapter V Final Disposals

Art. 11 - All contrary provisions are hereby repealed.

Art. 12 - This Law enters in vigor in the date of its promulgation

Article 5 is amended to read: "One judge each shall be appointed by the Secretary-General, the Prince-Monarch, and the Council of Floresters."

The First and Second Paragraphs of Article 5 are deleted, with the Third Paragraph becoming the Only Paragraph.

Article 6 is deleted.

Article 9 is amended to read: "All appeals will be directed to be processed and judged by the UCJ."

Amendment failed for lack of quorum.

PL6b - Amendment (Tisserand)

Article 9 is amended to read: "All appeals will be directed to be processed and judged by the UCJ, sitting en banc."

[En banc means the judges acting collectively].

Article 9, Only Paragraph is amended to read: "The party losing a case before the Upper Court of Justice may appeal to the Council of State, provided said party presents to the Council a brief stating reasons why the appeal to the Upper Court of Justice was adjudicated in a manner contrary to the Constitution or statutes of this Principality. The Council of State reserves the right of stare decisis."

[Stare decisis means "let the decision stand", in other words, the Council of State, in refusing to hear the appeal is affirming or supporting the decision of the Upper Court].

R5. Impeachment of Secretary-General Filipe Oliveira (Savalls)

TEXT

Considering that the Secretary-General, Filipe Oliveira has made an unsound interpretation of our Constitution contrary to the principle of common sense, having been incapable of seeing the joyful side of life, attaining a certain irony, offending his detractors, understanding the people, and seeing that he surrounds himself with repressive regulations and remains convinced that the citizens of Orange are only "to be administered", not free and capable people who made the decision to live together;

Considering that until now, all the acts which have come from his hand are based on contempt for the motivations of people who disagreed with his actions;

 

Considering that, viewed in this light, the things he so well excuses in interpreting his particular vision of our Constitution are contrary to common sense, especially that one does not speak of offensive political opinions, only of protecting certain saviors of the country.

Now therefore:

1. The Council of Floresters condemns this attitude, the policies, and the actions derived from the leadership of the Secretary-General and considers them inappropriate for an Orange government with common sense.

2. The Council of Floresters withdraws the confidence it accorded to the Secretary-General and suspends his government.

3. The Council of Floresters shall immediately vote to name a new Secretary-General.

4. Until a new Secretary-General is named, the Council of State shall take charge of the affairs of the Principality.

Whereas, that the Council of Floresters, has failed in its duty to the Laranjian People to give attention to the most basic and necessary legislation and

Whereas, the people of Orange have expressed their discontent with this lack of attention to their business.

Now, therefore, be it resolved:

1. That the Council of Floresters be dissolved, with elections to be held as prescribed in the Draft Electoral Law (PL7), beginning at 0001 hours Laranjian time, Friday, March 5, 1999 and ending at 2359 hours Laranjian Time, Sunday, March 7, 1999.

2. That the Council of State appoint a suitable person to serve as Returning Officer, as provided by PL7.

DECREE 01/98 (20 September 1998). Abolition of Secretariat of "Aguiarescos" Subjects.

The decree 18/09-01, that created the Secretariat of "Aguiarescos" Subjects, is revoked, for determination of the General Secretariat. A lifetime Secretariat goes against the art. 33 of the Constitution of Orange. The pertinent subjects to the history of Orange and the defense of human common-sense are under responsibility of the Foundation Peter Sayvant.

DECREE 02/98 (20 September 1998). Extraordinary Commission on the Economy.

The Extraordinary Commission of Economy is created, to elaborate the bases of the System of Simulated Economy - SSE, that it will aim at makes possible use of our currency, the Florim. The illustrious economists Ramon Llater, Francesc Savalls and Jean Tisserand are invited to integrate the Commission.
